Deed from Christopher and John Reynolds to William Hoyall (October 4, 1738 Isle of Wight County, Virginia)

This Indenture made the fourth day of October in the year of our Lord Christ One thousand seven hundred thirty eight Between Christopher Reynolds & John Reynolds his Son of Isle of Wight County of the one part and William Hoyall of the afores:d County of the other part Witnesseth that the s:d Christop:r Reynolds & John Reynolds his son for and in Consideration of the Sum of fifteen pounds ten shillings Curr:t money to them in hand paid and also the Sum of three shillings yearly rent have demis'd Granted Sett and to farm Letter and by these presents do demise grant Sett and to farm Sett unto the s.d W:m Hoyal his heirs Exors: Admons: and Assigns One certain plantation or tract of Land with the Appurtenances containing One hundred Acres be the same more or less Situate lying and being in the lower parrish of the afores:d County being the Land whereon the Said Hoyall now liveth bounded and followeth beginning at a Red Oak at the Creek side Carseys line so runing up that line to a Spannish Oak Carseys corner tree thence Easterly along the olfeild(?) side and so on to a mark'd red oak by the side of the said Hoyals Cart path thence up the said path to the main road and along the road to a white Oak by the Schoolhouse a line tree of James Tullaughs thence along down the s:d Tullaughs line to permentos line so along that line to Whitneys so bounding upon Whitneys to the Creek so up the Creek to the first Station together with all profitts benefits Commodities and Advantages to the said Land & premises belonging or in [-page break-] any wise Appertaining To have and to hold the said Land & premises with all and Singular the Appurtenances to the said William Hoyal his heirs Exors: Admons: and Assigns from the day of the date of these presents by and during all the whole term of twenty years from the first day of January next following and fully to be compleated & ended without impeachment of any manner of Waste Yielding and paying therefore yearly unto the said Christopher & John Reynolds or their heirs to three Shillings Or the Q'Rents of all the Land they now hold in the tract and the said Christopher & John Reynolds for themselves their heirs Exors: and Admons: doth Covenant Promise & Grant & agree to and with the said William Hoyal his heirs Exors: Admons: and Assigns and every of them by these presents in manner and form as followeth that is to say that they s:d Christopher and John Reynolds have good right and Lawfull Power & Authority to demise Grant and assure the said Land together with all houses Orchards and all premises above demis'd and also that he the said William Hoyal his Exors: Admons: or Assigns and every of them from henceforth unto the End of all the said term of twenty years shall or lawfully may have hold Occupy possess and enjoy the said Land and premises with all and Singular the Appurtenances thereunto belonging and every part and parcel thereof without any Sett trouble ... Molestation Iteruption or disturbance whatsoever of or by them the said Christopher and John Reynolds their heirs or Assigns or any other person or persons whatsoever and the said William Hoyall is to have the priveledge of all the said Reynolds's Sons for any or all sorts of timber for his use and the said William Hoyall doth bind himself his heirs &c at the end of the term afores: to have on the plantation afores:d fourty foot of housen(?) in good and two hundred bearing apple trees under a good fence and it is further Covenanted and agreed between the afores:d Christopher and John Reynolds and the afores:d William Hoyall that they do by these presents bind themselves their heirs Exors: Adm: & Assigns that if either Party above mention'd shall fail to perform any of the afores:d Covenants or Agreements they their heirs Exors: Admon: & Assigns shall and pay unto the other party his heirs Exors: Admons: or Assigns the full and just Sum of fifty pounds Sterling money of England to be well and truly paid upon demand In Witness whereof we have here unto set our hands and fix'd our seals the day & year above Written.
