This day came the parties by their Attorny and the Deft saving and reserving to
himself all and all manner of advantage and benefit of exception as well to the
Plfts. Writ as to this Defts. Prayer and has have to Impart here 'till the

The Sheriff having made return this Day that he had Attached of said Deft
Johnsons Estate two Shillings and Sixpence and the said Defts being Solemnly
Called and not appearing It is considered by the Court that the Plft recover
against the said Defts Johnson thirty four pounds eighteen Shillings the Debt
in the Declaration Mentioned together with his Costs by him in this behalf
Expended and the said Defts. in Mercy &C.
But this Judgment the Costs excepted is to be Discharged by the payment of of
Seventeen pounds Nine Shillings and Six pence with Lawfull Interest thereon
from the twenty Second Day of May 1763 to be Computed after the rate of 5 Pct.
P annum 'till the time of payment.
Memorandum the Plft Acknowledges Satisfaction for five Pounds fifteen Shillings
and Sixpence the first of September 1763.

Edmund Westray is appointed Surveyor of the road in the Room of Thomas
Whitney Gale and Ordered that he keep the same well Cleared from Woods Bushes
and all other obstructions thirty feet wide at least and that he erect or cause
to be Erected and kept in repair a stone or post with plain Inscriptions
thereon in large letters in every fork of his said Road and Causuay the same as
the Law Directs.

An Account of the Profits and Disbursments of the Estate of Martha
Westray was made oath to by the Guardian & Ordered to be Recorded.
On the Petition of Sundry the Inhabitants of this County setting forth that
they are Desirous of having a road out of Little John road a crop King Sale
Swamp below Benjamin Bakers Mill to the County Line. It is therefore ordered
that John Eley Jun.r Michael Eley & John Scarsbrooke Wills Gent &
Joshua Council or any three of them do View the Conviniencies &
inconvinienies attending the opening of the said Road & make report thereof
to the Next Court.

On the Petition of Benjamin Westray against John Ward for nine Shillings
and Eleven pence and one hundred & twenty three pounds of Nett tobacco
& fifteen Shillings due by Judgment this Day the Deft Appeared &
Confessed the Court that the Plft recover against the said Deft one pound ten
Shillings & Sixpence together with his Costs by him in this behalf
expended.
